Copyright infringement notices

To request removal of material you believe infringes your copyright, send a written notice that includes:

1. Your physical or electronic signature, or the signature of a person authorized to act for the copyright owner.
2. Identification of the copyrighted work, or a representative list if the notice covers multiple works on TownSpark.
3. Identification of the material you want removed and enough information for us to locate it, preferably the exact TownSpark URL.
4. Your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

We may send a copy of the notice, including the complainant’s contact information, to the user who supplied the material. TownSpark responds expeditiously to valid notices by removing or disabling access to the identified material.

Counter-notifications

If your material was removed because of a copyright notice and you believe that happened because of mistake or misidentification, you may send our designated agent a written counter-notification containing:

1. Your physical or electronic signature.
2. Identification of the removed material and where it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
4. Your name, address, and telephone number.
5. A statement consenting to the jurisdiction of the appropriate U.S. federal district court and agreeing to accept service of process from the person who submitted the original notice or that person’s agent.

We will provide a valid counter-notification to the original complainant. TownSpark may restore the material 10 to 14 business days after receiving it unless our designated agent first receives notice that the complainant filed a court action seeking to restrain the disputed activity.

Repeat infringers and other removal

TownSpark maintains records of copyright notices and counter-notifications. In appropriate circumstances, we suspend or terminate users who repeatedly infringe copyrights. We may consider the number, timing, severity, and apparent validity of notices, counter-notifications, retractions, and other reliable evidence. TownSpark may also remove or disable material when it has actual knowledge of infringement or when infringement is apparent.

Important warning

Knowingly making a material misrepresentation that content is infringing, or that content was removed by mistake, may result in liability under 17 U.S.C. § 512(f). Consider speaking with an attorney before submitting a notice or counter-notification if you are unsure about ownership, authorization, or fair use.
